1. The agreement

These Terms of Service form a binding agreement between you and Feihe Cross-border E-commerce (Guizhou) Co., Ltd. ("we", "us"), operator of Cross-Border Engine (跨境引擎). By creating an account, starting a trial, or using the service, you agree to these terms and to our Privacy Policy.

If you accept these terms on behalf of a company, you confirm you are authorised to bind that company, and "you" means that company.

If you do not agree, do not use the service.

2. Who may use the service

You must be at least 18 years old — or the age of majority where you live, if higher — and legally able to enter into contracts. The service is a business tool intended for sellers and operators of cross-border commerce; it is not designed for, and must not be used by, consumers acting for purely personal or household purposes.

We do not target the service at children and will close any account we find is held by a person under 16.

You are responsible for ensuring that your use of the service is lawful where you are located, and that you are not subject to sanctions or export restrictions that prohibit your use of it.

3. Your account

We will never email you asking for your password. If you receive such a message, it is not from us — forward it to [email protected].

4. What the service is — and is not

Cross-Border Engine is an operations platform for small cross-border sellers. Depending on your plan it helps you research products and sources, calculate landed cost and margin, generate listing copy and assets, prepare listing data packages, monitor logistics and orders, organise leads and buyers, and review profit.

What it is not

5. Third-party platforms

The service can surface publicly available information from third-party marketplaces and sources, and can help you prepare data for them. Third-party platforms are not under our control.

6. Acceptable use

You agree not to use the service to:

We may investigate suspected breaches and may suspend or close an account that breaches these rules (see section 14). Where a breach is capable of remedy, we will normally ask you to remedy it first.

7. Plans, billing and automatic renewal

Free plan and trial

The free plan has no time limit and requires no payment details. A 7-day trial of paid features requires no card and does not convert into a paid subscription automatically — if you do nothing, it simply ends and you continue on the free plan. We will remind you by email before it ends.

Paid subscriptions

Payment, taxes and invoices

Price changes

We may change prices. Existing subscribers are notified at least 30 days before a price change applies to them, and may cancel before it takes effect.

8. Refunds and cancellation

Your first paid subscription can be refunded in full within 14 days of the charge, for any reason. Full conditions, the exceptions, and how to ask are set out in the Refund Policy, which forms part of these terms.

Nothing in these terms or that policy reduces any statutory right you have, including the cancellation rights available to consumers in the EU and UK.

9. Your content and intellectual property

You keep ownership of everything you put into the service and everything you generate with it — product research, pricing workbooks, listing copy, images, documents and data exports ("your content").

To operate the service you grant us a limited, non-exclusive, royalty-free licence to host, store, process, transmit to the processors listed in our Privacy Policy, back up and display your content — only as needed to provide the features you use, and for no other purpose. This licence ends when you delete the content or close your account, except for backups that expire on their normal cycle and records we must retain by law.

You confirm that you have the rights needed to upload your content, and that processing it as described does not infringe anyone else's rights.

AI-generated output. As between you and us, you own the output generated for your account, to the extent the law allows. Outputs can resemble material generated for others, because models are probabilistic; we cannot warrant that an output is unique or free of third-party rights, and you should review anything you publish.

10. Our intellectual property

The service — its software, interface, brand, documentation, prompts, algorithms and the compiled structure of its data — belongs to us and our licensors. Your subscription grants you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during your subscription. No other rights are granted, by implication or otherwise.

We welcome feedback. If you send us suggestions, you allow us to use them without obligation or compensation.

11. Availability and changes

We work to keep the service available and to tell you in advance when we know it will not be. Planned maintenance is announced in-app. Because some features depend on third-party platforms, sources and model providers, we cannot promise uninterrupted availability and we do not offer a guaranteed uptime percentage in these terms.

We may add, change or retire features. If we retire a feature that is material to your paid plan, we will tell you at least 30 days in advance where reasonably possible, and you may cancel with a pro-rata refund of unused prepaid time if the change materially reduces what you paid for.

We may suspend the service for security reasons, for maintenance, or where required by law, for as long as necessary and no longer.

12. Disclaimers

Except where the law does not allow it to be excluded, the service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or that any data it surfaces is complete, current or accurate for your market.

Market data, demand signals, price suggestions, competitor information and generated content are estimates or drafts derived from limited sources. They can be wrong. You must verify anything you rely on before committing money, inventory or a listing.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, and subject to the paragraph above:

These limits apply regardless of the legal theory asserted, and survive termination. They are a fundamental basis on which we offer the service at its current price.

14. Suspension and termination

By you. You can stop using the service at any time and close your account from account settings. Closing your account cancels any active subscription at the end of the current period and starts the deletion process in our Privacy Policy. Export anything you want to keep first — deletion is irreversible.

By us. We may suspend or close your account if you materially breach these terms, if we are required to by law, or if your use presents a security risk or a risk to other users. Except in urgent cases (such as a live security incident or a legal requirement), we will give you notice and a reasonable chance to remedy the breach first.

Refund on our termination. If we close your account for a reason that is not your breach, we will refund the unused portion of any prepaid fees.

Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability and governing law — survive.

15. Governing law and disputes

These terms are governed by the laws of the People's Republic of China, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

Nothing in this section takes away protections you cannot waive. If you are a consumer resident in the EU, the UK, or another jurisdiction whose mandatory consumer-protection law applies, you keep the benefit of those mandatory rules and your right to bring proceedings in the courts of your country of residence. If you are a data subject in the EEA or UK, you keep your right to complain to your local supervisory authority under Art. 77 GDPR.

Before anything else: talk to us

If a dispute arises, email [email protected] with a description of the issue and what you would like us to do. We will try in good faith to resolve it within 30 days. Both of us agree not to start formal proceedings before that period ends, except to prevent irreparable harm or to preserve a claim.

If we cannot resolve it, disputes are subject to the exclusive jurisdiction of the competent courts at our place of establishment, subject to any right you have to bring a claim in your local courts under mandatory law. Claims must be brought within one year of the date you knew or should have known of the facts, where the law permits such a limit.

16. Changes to these terms

We may update these terms. The version number and date at the top of the page always identify the current text, and earlier versions remain available on request. For material changes we will notify registered users by email at least 30 days before they take effect, and where the change is significant we will ask you to accept it explicitly.

If you do not agree to a change, stop using the service and close your account before the effective date; you will not be charged for a period you have not used. Continuing to use the service after the effective date means you accept the updated terms.
